RE: Formal Request for Disqualification of Participant “ShiftyTV” for Violation of Official Rules
This letter serves as a formal request for the immediate disqualification of participant “ShiftyTV” from the World Series of Warzone (“WSOW”) qualifications due to a material violation of the WSOW Official Rules (“Rules”), specifically Section 4.4(b) regarding mandatory use of facecams during tournament play.
Pursuant to Section 4.4(b) of the Rules, which states:
“All Participants are required to have facecam (or webcam) turned on and it must be always pointed at their face while competing in the WSOW Open Qualifier Bracket & Finals Phase, WSOW Last Chance Qualifier (LCQ) and WSOW Global Final. Please consider this rule before competing in the competition if for any reason you believe you would be unable or unwilling to comply.”
It has come to our attention, through review of stored tournament footage, that participant ShiftyTV failed to comply with this mandatory requirement during the WSOW qualifications. This constitutes a clear and unambiguous breach of the Rules to which all participants explicitly agreed upon entering the tournament.
We respectfully assert that the lack of consistent enforcement of this regulation among all competitors significantly compromises the integrity of our competition. Moreover, such inconsistent application may potentially breach guidelines established by the Federal Trade Commission concerning Competition Guidance. It is pertinent to mention that the foundational documents governing competition have been formulated in collaboration with the Antitrust Division of the U.S. Department of Justice. These documents are designed to uphold and promote robust competition policies in accordance with U.S. standards. Therefore, it is imperative that enforcement is uniform and equitable to preserve the fairness and credibility of the competition and to ensure compliance with relevant federal guidelines.
Furthermore, as per Section 9.1 of the Rules, the Administration reserves the right to “monitor compliance with these Rules, investigate possible breaches of these Rules and impose sanctions for violations.” We assert that this situation warrants such investigation and subsequent disciplinary action.
It is fundamentally unacceptable and insufficient for a player, upon attending a LAN event, to simply perform to their own standards of adequacy while engaging in actions that contravene established rules. This does not, under any circumstances, excuse acts of cheating, violations of terms of service, or fraudulent behavior. Moreover, it has been definitively established that the user in question has committed multiple breaches of Activision's Terms of Service. These violations constitute fraudulent activities that not only undermine the integrity of the competition but also rob legitimate competitors and the broader public of a fair and just gaming environment. Additionally, compelling evidence has emerged, notably during Repullze's watch party of a recent tournament, that ShiftyTV has engaged in cheating. This incident has raised serious questions, particularly concerning why ShiftyTV chose to disable their facecam during the event. As a player often regarded as a “top player,” it is expected that they would adhere strictly to the rules; however, ShiftyTV has shown a consistent disregard and disrespect for these regulations. This behavior is deeply concerning and calls for a rigorous review and appropriate disciplinary measures to uphold the fairness and integrity of the gaming community. Such actions tarnish the reputation of esports and betray the trust placed in players to compete honestly and honorably.
We respectfully remind the Administration that failure to address these allegations in a timely and thorough manner could potentially expose Activision Publishing, Inc., FaceIT, and other involved parties to legal liability under various state and federal laws. Such liability could include, but is not limited to:

These actions could include, but are not limited to, submitting formal complaints to the Federal Trade Commission, Bureau of Consumer protection, the Civil Division of the Department of Justice, and the Attorney General's Offices of New York and California.
